Work-related risks and any related liability issues, at an individual and a collective level, are very much in the public eye, with mounting pressure on employers in terms of policies, administration and publicity.

The legislation on working conditions and safety standards gets tighter every day. Employment relations become progressively more flexible and thus more diffuse. More and more different parties in the chain are hit by legal claims. Developments in employment law in terms of rehabilitation, but also in dismissal cases clamour for attention.

As a team we join our knowledge and experience, in and outside the courtroom, and in enforcement procedures. We have a sixth sense for frequently precarious relationships, and a keen eye for damage control. Here, the correct application of regulations for tax purposes can play a role.

Recently, we have:

  • advised on the design of a collective scheme settling occupational disease claims;
  • successfully contested in tax court the taxability of a sizable amount paid under an accident insurance policy;
  • advised on the structure of the employers’ report that the Dutch Labour Inspectorate may require employers to file after workplace accidents;
  • published on the quasi-employer’s duty to insure the loss sustained by self-employed professionals;
  • successfully raised defences against employers’ claims under Sections 7:658 and 7:611 Dutch Civil Code.
