In construction, many parties are involved. With our combined knowledge and experience we have built an integrated construction and insurance practice. This gives us an overview of the entire playing field of relationships in construction and insurance law. Project developers, other commissioning parties, contractors and insurers all play their part. The various eligible types of contract (Uniform Administrative Conditions for the Execution of Works, Uniform Administrative Conditions for Integrated Contracts, and so on) are the instruments to use to steer things in the right direction.
An important tool is the right insurace. Our broad experience with insurance schemes that are relevant to construction, such as CAR, BOV, AVB, BA, DSU and Landmaterieel, allow us like no other to assess coverage issues in complex loss claims. We also apply our knowhow during the contract phase, to clarify the division of liability risks over the different parties, and to solidify our client’s position. Herewith we reach efficient solutions after calamities. Conversely, our experience with construction and real property helps to quickly cut to the chase in disputes with and for insurers.
Recently we have:
- counselled contractors in the settlement of complex claims for damages caused by construction work under CAR-, BOV- en AVB-policies;
- advised insurers on the concurrence of insurance policies (CAR, Property, AVB, Landmaterieel) and the possibilities of recourse against the parties involved in the construction;
- organised a knowledge-sharing session at NARIM (Dutch Association of Risk Insurance Managers) on the coverage of construction defects under CAR and property insurance;
- counselled commissioning parties on the termination of a building contract and the recovery of their loss;
- advised on the back-to-back drafting of building and insurance contracts;
- advised architects and constructors on coverage under their professional liability insurance and the liability limitations in the DNR 2011.
